The following terms & conditions govern your use of Quikka Shippa Shipping systems, owned and operated by Quikka Shippa Shipping here on after referred to as Quikka Shippa Shipping, the company,  including but not limited to our web or cloud application, IOS app as well as Android App, web tracking and shipment update services, online billing and services platform.

Your acceptance of our terms and conditions and subsequent use of our website, mobile app, and systems or any other services offered will hereby constitute an agreement to our terms of service and you are agreeing to have the terms herein stand as legally binding. In addition, by using our overseas address / addresses, shipping an item to the company’s address, whether on behalf of a third party or yourself, will imply your full acceptance of all of Quikka Shippa Shipping terms of use and explicitly forms your acceptance of the terms and conditions outlined in this document, as such we ask that you  PLEASE READ THIS DOCUMENT CAREFULLY AND IN ITS ENTIRETY.

Quikka Shippa Shipping reserves the right to and may at any time in the future unilaterally make changes or modifications to these existing terms by removing or adding to the same with or without notice, however, updates to the terms of service will be published via email to the email on your account. The company is not liable for any failure on the user’s part in failing to keep abreast with the modification or changes. The company will not remedy any claim or loss as a result of failure to follow policy and or any breach of these terms.

DEFINITIONS

(a) “Package” means any container, envelope, document or parcel that is acceptable by us for delivery

(b) “Shipment” means all Packages that are tendered to and accepted by us for delivery and that travel hereunder under a single (Airway Bill) receipt.

(c) Branch- Collection point or outpost operated by the company.

Content: information, graphics, animations, products, features, functionality, services, and links on Quikka Shippa Shipping portals.

AGREEMENT TO TERMS

By giving us your Shipment, you certify that shipment details are complete and accurate and you agree whether or not you are acting on your own behalf or as an agent for and on behalf of any other person having interest in this Shipment to all the terms and conditions hereof and to any applicable tariff.  No one is authorized to alter or modify the terms of our agreement.

Rates for our service are subject to change without notice

We shall not be liable to you or to any third-party for any modification, rate change, suspension or discontinuance of the Service.

We reserve the right to refuse any shipment you send with us. 
In the event that we refuse to accept a shipment from you, we may attempt to notify you by contacting the e-mail and/address/phone number provided by you.

You agree to provide current, complete and accurate purchase and account information. You agree to promptly update your account and other information, including your email address, home address and telephone number, so that we can contact you as needed.

Errors, Inaccuracies And Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

Ownership

All content, data, information, and materials, presented and displayed on our Website (“Content”), including any intellectual property rights in such Content (including without limitation) wording, graphical images, motion pictures, sound events, software code in various languages, or other intellectual property rights associated with our website, social media accounts on all platforms, are owned and is the property of Quikka Shippa Shipping, its licensors, and is protected by applicable laws regarding intellectual property. Users of the Website must assume that all content is protected by intellectual property rights, and therefore written consent from Quikka Shippa Shipping is required before any part thereof can be used.

Indemnification

You agree to indemnify, defend and hold harmless Quikka Shippa Shipping and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Your Obligations

(a) You warrant that each article in the shipment is properly described on the Receipt/Airway Bill and any other documents acceptable and is properly marked addressed and packed to ensure safe transportation with ordinary care in handling.

(b) You agree to pay all shipment charges and destination duties and taxes for this shipment if the receiver or third party does not pay.

(c) You agree to pay all shipment charges including but not limited to incorrect declaration of cargo, improper or insufficient packing securing marking or addressing of the Shipment, or for the acts or omissions of the recipient or anyone else with an interest in the Shipment.

Registration & Passwords

The User is solely responsible for keeping their password and account details confidential and agrees to be responsible for all activities that occur under the User’s account name and password. If there is any suspicious action or unauthorized use of your account, the Company should be notified immediately by email or via telephone. The Company reserves the absolute right in its discretion, not to issue a password or access to any person or entity if verification of information fails during validation. Please do not share your password with family or other associates or any third party as this may cause serious implications or losses for the user, for which the company is not liable. In the case the company recognizes these actions it may terminate your account without notice, considering it a breach of said agreement.

Responsibility For Payment

Regardless of your providing us with an alternative payment method or instructions, you will always be primarily responsible for all reasonable charges and possible surcharges customs and duties assessment including fees related to our prepayment of the same, governmental penalties and fines, taxes and our Attorneys Fees and legal costs related to this shipment.  You also will be responsible for any reasonable costs we incur in the shipment or warehousing of the shipment pending ultimate dispatch to you.

Online Portals

Quikka Shippa Shipping may discontinue, suspend or modify our website and / or any other portals or platforms owned and operated by the company at any time without notice, and Quikka Shippa Shipping may block, terminate or suspend a user’s access to our user portal and / or any other portals /  websites operated by the company at any time for any reason in its sole discretion, even if access continues to be allowed to others.

Accurate Information

The company uses information provided upon your signing up for our services to validate user transactions and instructions. Please keep your account up to date with accurate information and use accurate information at all times. Failure to do so can result in restrictions in collecting, clearing and importing your shipments. As well as your account may be maliciously used without your permission or consent.

Delayed Shipments

We will make every effort to deliver your Shipment according to our regular delivery schedules, but we are not liable for any delays in collecting a shipment, transporting a shipment (including delays caused by any diversion) and delivering a shipment occasioned by the following circumstances:-

(a) act of God including but not limited to storm, tempest or flood;

(b) act of war hostilities riot or civil commotion or the threat or fear of such conditions prevailing;

(c) criminal malicious or negligent actions or acts or omissions of third parties.

(d) industrial action or unforeseeable traffic conditions;

(e) suspension or cancellation of transport services by reason of or of the threat or fear of inclement weather;

(f) fire, lightning or explosion;

(g) seizure under legal process;

(h) your act, default or omission of whatever nature, or act, default or omission of your employees or agents or any person having any interest in the goods;

(i) insufficient or improper packing labeling or addressing; or

(j) the unavailability at the delivery address of the consignee or other authorized recipient.

Invoicing & Evaluation

Quikka Shippa Shipping uses invoices uploaded to process packages through the relevant border and customs agencies, please be aware that invoices bearing discounts exceeding 25% percent or more for purchases, the discount is not honoured as a part of the product valuation, the company based on instruction from border officials may not acknowledge discount amounts exceeding 25%. Please also note that the discount rate does not circumvent item Value or fair market value of purchases. These attributes are translated into our inland fees for packages or shipments. 

Fraudulent Invoicing

Quikka Shippa Shipping uses invoices uploaded to process packages through the relevant border and customs agencies on your behalf, please be aware that editting  invoices to lower the value of your shipment will attract fines, fees and charges by the company at the company’s sole discretion. Falsifying your invoice/s may result in delays in acquiring your packages which may result in the company being forced to spend additional time trying to valudate informations and communicating to and from Jamaica customs and the customer . Quikka Shippa Shipping has the right to request proper invoices for ALL shipments. All packages require proper invoices. Packages without a proper invoices will result in delays and/or additional storage costs. It is important to upload the correct invoice/ invoices for your shipment in the event your shipment is lossed or damage whilst in the care of Quikka Shippa Shipping we will compensate you the customer for the full amount for the order once the order details are the same on the invoice. In the even customer modify their shipment invoices to evade customs charges and their shipment is lossed / damaged Quikka Shippa Shipping will only make compensation for the amount on the invoice uploaded by the customer. By using our websites, portal and services you accept all of our tems and conditions surrounding fraudulent invoices. You are also aware that if it is observed that you have uploaded fraudulent invoices either by accident or on purpose there will be a minimum fine of $5000JMD.

Processing Fees & Company Charges

Packages weighing more than one (1) pound are eligible to company charges and processing fees. Processing fees may range from 150JMD, 10% of the cost of the total charged for the package but not limited these amounts. Processing fees are system / company generated and may vary at times depending on the process to ship, treat with, store and handle same packages.

Incorrect Shipment

Quikka Shippa Shipping is not liable in these cases when the order received does not reflect entirely what the user or customer purchased. All queries, in this case, should be forwarded to the seller. Please note the internal costs associated with said shipments have to be settled, and once settled it is the responsibility of the customer to ensure they rectify all issues with the SUPPLIER.

Liabilities Not Assumed

Quikka Shippa Shipping nor any of its servants or agents shall be liable for any loss or damages, whether direct, incidental, special or consequential in any event for any shipment given to us in excess of the amount stated in on the invoice provided to the company by the customer whether or not we knew or should have known that such damages might be incurred, including but not limited to loss of income or profits.

(b) We will not be liable for loss of or damage to shipments of money or other prohibited items.

(c) We will not be liable for your acts or omissions including but not limited to incorrect declaration of cargo, improper or insufficient packing, securing marking or addressing of the Shipment, or for acts or omissions of the recipient or any one else with an interest in the Shipment. Also we will not be liable if you or the recipient violates any of the terms of our agreement.  We will not be liable for loss, damage, delay, shortage, misdelivery, nondelivery, misinformation or failure to provide information in connection with Shipments of money as defined above or other restricted or prohibited items.

(d) We will not be liable for loss, damage, delay, shortage, misdelivery, non-delivery, misinformation, or failure to provide information caused by events beyond our control including but not limited to acts of God, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions or acts of public authorities (including Customs or Health Officials).

Receiving, Acceptance, Refusal of User’s Packages & Mail

The Company will receive all packages and mail delivered to the global forwarding address by courier, post, or via walk-in for the User. Receiving or signing for packages and mail on behalf of the User does not constitute the Company’s acceptance of the package or mail. Acceptance of packages and mail is subject to inspection by the Company. The Company is obligated to carry out a visual inspection of the external package. Any damage found will be noted, however, the Company is not obligated to verify the integrity of the contents. The user acknowledges that inspections carried out by the Company are for the sole purpose of determining whether the contents of the User’s package or mail can be shipped by air or by ocean freight. User shall not hold the Company liable for damage to the contents of a package or mail where the packing was found to be inadequate for the nature of the goods whether the Company ought to have known that such damage was likely to occur or not.

The Company may at its discretion refuse any package or mail and will notify the User promptly of the reason for refusing the package or mail. The user will cooperate promptly with all reasonable requests of the Company to resolve instances where packages or mail have been refused. Refused packages and mail will be held in storage for a maximum of thirty (30) days prior to disposal by the Company. The Company may at its discretion assist the User in disposing of refused packages, User acknowledges and agrees to prepay any additional fees, if applicable, that may arise with respect to assistance provided by the Company to dispose of such packages.

Storage & Disposal Of Packages

The Company may at its discretion dispose of any package or mail stored in our warehouse in excess of thity (30) days after same package is set ready for pickup or delivery. The user will cooperate promptly with all reasonable requests of the Company to resolve instances where packages or mail are being stored. Packages and mail will be held in storage for a maximum of thirty (30) days prior to disposal by the Company. The Company may at its discretion assist the User in disposing of refused packages, User acknowledges and agrees to prepay any additional fees, if applicable, that may arise with respect to assistance provided by the Company to dispose of such packages.

Disposal Of Shipments Not Collected

We reserve the right to dispose of any shipment not collected by the recipient/addressee or any duly appointed agent and remaining in our office/warehouse for more than THIRTY (30) DAYS after notification by us that the shipment has arrived. You agree to indemnify us in regard to any claim made in respect of our actions under this clause.

Inland Charge

Inland fees for Inland charges comprise several costs used to simplify our service offering to our customers and to make shipping a less complex process. These costs are but not limited to airline fuel charges, overseas storage fees where applicable, logistical deliveries, Insurance, and overseas processing and handling. 

Additional terms

The company reserves its right to not disclose its shipping partners, whether locally or overseas. We do not disclose to any user or individual any trade associations and agreements. By using our service it is understood that this policy is accepted and acknowledged.

Please note shipments may be inspected before leaving the port of departure by the ruling and governing authority of that jurisdiction.

Items Not Acceptable For Shipment

We do not accept as a Shipment the following:-

(a) Money/cash, or items readily convertible to money (including but not limited to coins or negotiable instruments equivalent to cash such as endorsed stocks and bonds) and jewelry

(b) Shipments of items accepted by mistake

(c) Items restricted by IATA (International Air Transport Association) or IAC (International Civil Organization)

(d) Items which in our discretion we cannot transport legally or safely.

You certify that your shipment is not restricted by any of the above limitations.

We reserve the right to reject packages based on these limitations or for reasons of safety or security.

Restriction Items

Items that cannot be lawfully shipped to their destination country will be disposed of, if it is an illegal item the relevant authorities will be notified and actions are taken. In addition, the company reserves the right to not forward or ship any item or items that will conflict with or pose issues with state licensing and permits.

Consignee Information: 
Failure to correctly use your shipping address as illustrated may cause delays in identifying shipments at our overseas location. This will also cause inadequate information to be updated in our system to provide customs officers or agents with, once the shipment reaches its destination country. Please correctly place your FULL NAME (as it appears on government identification cards) and address with account number whenever shipping items or packages to our overseas address.

Some Items require special permits or authorization from local government agencies and or body corporates. Quikka Shippa Shipping does NOT accept liability for failure in obtaining the requisite permits BEFORE shipment to our address. We may be notified of your intention to ship these items via our various support channels. Failure to furnish documents in an adequate time period may result in items being detained and disposed of by Jamaica Custom Agency and border control. In addition, certain items may only be imported in large quantities under a commercial entity or agent.

Commercial Shipments

Jamaica customs may deem your shipment to be commercial by its invoiced quantity. This may cause-specific and unforeseen custom fees and charges to be applied to shipments and demanded from you prior to the release of said shipment.

Detained Goods

There are cases where the shipment, upon border control or customs inspection, and by applicable law requires the respective agent or officer to “DETAIN” said shipment(s) because of the following but not limited to;

Inadequate invoice provided
Incorrect consignee information ( user incorrectly inputted address information)
The item(s) are restricted
The item(s) require a permit. Where none is provided or applied for this may constitute a breach and fines may be applicable)
Item being prohibited

Claim For Loss, Damage Or Delay

ALL CLAIMS MUST BE MADE IN WRITING AND WITHIN THE TIME LIMITS SET OUT BELOW.

(a) The right to damages against you within the limits of clause 9 above shall be extinguished within three (3) months from the date of delivery of the Shipment or from the date on which the Shipment should have been delivered

(b) Within 60 days of notification to us of the claim it must be documented by sending to us all relevant information about it. We are not obligated to act on any claim until all transportation charges have been paid and the claim amount may not be deducted from those charges

(c) If the recipient accepts the Shipment without noting any damage on the delivery record we will assume that the Shipment was delivered in good condition. In order for us to consider a claim for damage, the contents, original shipping cartons and packing must be available to us for inspection.

Right To Inspect

Your shipment may at our option or at the request of governmental authorities be opened or inspected by such authorities or us at any time.

Customs Clearance

By giving this shipment to us, you hereby agree solely for performance or customs clearance and certify us as the consignee for the purpose of designating a customs broker to perform clearance.  In some instances local authorities may require additional documentation confirming our appointment.  It is your responsibility to provide proper documentation and confirmation required.

Rounding Up Of Weight

Quikka Shippa will round up package weight to the next pound. Example: If your package weighs 7.35 pounds, we will round the .35 punds up to another pound which will result in your package weight being 8 pounds. 1.1 pound is rounded up to 2 pounds, 2.13 pounds is rounded up to the next pound which is 3 pounds. Packages are rounded up and not prorated.
